1. About these Terms
These Terms govern installation and use of the Get Up and Move Windows desktop utility (the “App”). The App is provided by XYNTRA Holdings Limited, company number 17184090, of 71–75 Shelton Street, London, WC2H 9JQ, United Kingdom (“XYNTRA”, “we”, “us” or “our”).
By ticking the acceptance box and installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
2. Eligibility
The App is intended only for people aged 18 or over. By installing it, you confirm that you are at least 18 and legally able to agree to these Terms.
3. What the App does
Get Up and Move is a light-hearted general wellbeing utility intended to interrupt prolonged computer use with reminders to move. The current version uses a 30-minute default work session. Users may select sessions of 30, 35, 40, 45, 50 or 55 minutes, although sessions longer than 30 minutes are limited to two uses per calendar day.
When a work session ends, the App displays a three-minute movement break and rotates general suggestions such as taking a short walk, gently changing position, moving the shoulders, performing shallow supported squats if comfortable, stretching, or getting a drink.
A five-minute snooze may be used up to four times in a reminder cycle. Sleep and wake controls allow reminders to be paused and restarted.
4. Installation and operation
The App is designed for compatible Windows 10 and Windows 11 computers. It may create desktop and Start-menu shortcuts, a notification-area icon and an automatic start-up entry so that it opens when you sign in to Windows.
You can minimise, pause, wake or close the App using the available controls. You may uninstall it using the supplied uninstaller or the relevant Start-menu option.
5. Local settings and offline use
The current App works offline, does not require an account and does not transmit usage information to XYNTRA. It stores limited operational settings on the computer, including the date, number of longer sessions used, disclaimer version and local acceptance timestamp.
The App includes links that may open the XYNTRA website in your default browser. Visiting the website requires an internet connection and is governed by the website privacy and cookie information.
6. Movement safety
All movement suggestions are optional. Choose only movements suitable for your health, mobility, clothing, footwear, surroundings and circumstances. Ensure that you have enough clear space and that moving will not create a risk to you or anyone else.
Stop immediately if you experience pain, dizziness, faintness, unusual shortness of breath or feel unwell. Do not follow a reminder while driving, operating machinery, carrying out a safety-critical task, or where standing or moving would be unsafe, disruptive or prohibited.
7. Medical and wellbeing disclaimer
The App is a general wellbeing and habit-reminder utility. It is not a medical device, fitness programme or substitute for professional advice. It does not provide medical advice, diagnosis, treatment, rehabilitation, occupational-health assessment or emergency support.
Suggestions are general and are not personalised to any medical condition, disability, injury, pregnancy, fitness level or workplace risk. Consult an appropriate healthcare professional before changing your activity if you have a health concern, are pregnant, are recovering from illness or injury, or are unsure whether an activity is suitable.
“Dr Mark” is a light-hearted character used within the App. The name and presentation do not mean that movement suggestions are provided or approved by a medical practitioner.
8. Your responsibility
You decide whether, when and how to respond to a reminder. You remain responsible for your own health and safety, workplace obligations and compliance with any advice given by a healthcare professional or employer.
The App cannot determine whether you have been sitting, whether a movement was completed, or whether a suggestion is appropriate for you.
9. Reliability and compatibility
Timers and reminders may be affected by Windows settings, sleep mode, power management, system load, security software or other applications. We do not guarantee that every reminder will appear at an exact time or that the App will remain compatible with every system configuration or future Windows update.
Do not rely on the App where a missed or delayed reminder could create a safety, medical, legal or operational risk.
10. Acceptable use
You may use the App only lawfully and for its intended purpose.
- Do not alter, disable or circumvent security or installation controls except where applicable law permits it.
- Do not distribute modified copies in a way that suggests they are official XYNTRA releases.
- Do not use the App or its characters, graphics or branding to infringe rights or mislead others.
11. Licence and intellectual property
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the App in accordance with these Terms. The App, its original code, text, artwork, characters and branding are owned by or licensed to XYNTRA.
This licence does not transfer ownership and does not permit commercial resale, sublicensing or unauthorised redistribution.
12. Free availability and future versions
The current App is supplied without charge. Holding or using the free version does not authorise us to charge you automatically.
Future versions, mobile applications or optional online services may have different features, privacy practices or commercial terms. Any price and applicable terms will be presented before a purchase, and materially different processing will be explained before it begins.
13. Updates and support
We may provide updates for compatibility, security, reliability or feature improvements. An update may replace or change earlier functions. Support questions may be sent to support@xyntra-ai.com.
14. Ending use
You may stop using and uninstall the App at any time. Uninstallation removes the installed program files and start-up entry as designed, subject to ordinary Windows behaviour and any files retained by Windows itself.
15. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when you accepted these Terms, business losses suffered by consumers, or loss caused by failure to follow safety information, unsuitable movement, Windows configuration, third-party software or hardware, or circumstances outside our reasonable control.
16. Changes to these Terms
We may update these Terms for legal, safety, technical or product changes. If an update materially affects your rights, we will provide reasonable notice through the App, installer, download page or another appropriate method. A new acceptance may be requested for material changes.
17. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections and rights to bring proceedings available under the law of the country where you live.
